Terms of Service
Last updated: May 2026. By purchasing an evaluation or using an Opus Funded account, you agree to these terms.
Operator:Opus Funded is a brand operated by FundedWithFutures LLC, a registered United States limited liability company. All payments, payouts, refunds, and contractual obligations referenced in these Terms run to and from FundedWithFutures LLC. Bank wires and ACH transfers from us may appear on your statement under the sender name “FundedWithFutures LLC”.
1. Simulated trading
Opus Funded is a simulated proprietary trading firm. No real customer funds are deployed to live markets through your evaluation or funded account. All orders are executed against live market data without real market participation. Profit and loss figures reflect simulated outcomes only.
2. Evaluation rules
Every evaluation has a published profit target, daily loss cap, max loss cap, minimum trading days, and consistency rule, all listed in plain dollars on the pricing page at time of purchase. Breaching any single rule blows the account. Rules cannot be amended retroactively — the snapshot taken at purchase is authoritative for that account's lifetime.
3. Funded accounts and profit split
Passing an evaluation entitles you to a simulated funded account with a 90% profit split. Payouts are processed daily on request once the account has met the minimum trading-day requirement. We reserve the right to withhold payouts pending review if rule violations or coordinated trading is suspected; see §6.
4. Prohibited behavior
The following will void your evaluation or funded account without refund: latency arbitrage; copy-trading between Opus accounts and external accounts; automated trading bots (unless explicitly approved); using AI assistants to place trades; account sharing; opening positions to hedge an unrelated account's exposure; any behavior reasonably construed as gaming the eval to extract funds rather than demonstrate trading skill.
5. Account ownership
All accounts are non-transferable. The natural person who registered the account is the sole authorized user. Sharing login credentials, allowing third parties to trade on your account, or operating multiple identities is grounds for termination.
6. Withholding and review
Opus reserves up to 30 calendar days to review a payout request if the trading record suggests a rule violation, coordinated trading, exploitation of pricing/feed gaps, or any prohibited behavior in §4. If a review concludes a violation occurred, the account is terminated and no payout is made. If no violation is found, the payout is released with normal processing.

9. Limitation of liability
Opus Funded is not liable for losses resulting from market data provider outages, platform downtime, or third-party service failures. Our maximum liability for any claim is limited to the purchase price of the affected evaluation.
10. Governing law
These terms are governed by the laws of the State of Wyoming, USA. Disputes are resolved by binding arbitration in Wyoming.
11. Changes
We may update these terms; the version in force is the one published on this page at the time of your purchase. Material changes will be announced via email at least 14 days before taking effect.
